CLIMB IT Solutions provides information technology consulting, managed IT services, AI and automation consulting, Odoo ERP implementation, cybersecurity services, cloud services, data analytics, and related professional services to businesses. Specific services, deliverables, timelines, and fees are defined in individual service agreements or statements of work executed between CLIMB IT Solutions and the client.

2. Use of Website

You may use our website for lawful purposes only. You agree not to:

  • ✓ Use the site in any way that violates applicable federal, state, or local law
  • ✓ Attempt to gain unauthorized access to any portion of the website or its systems
  • ✓ Use the site to transmit malware, spam, or other harmful content
  • ✓ Reproduce, distribute, or create derivative works from site content without written permission

3. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of CLIMB IT Solutions or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

4. Client Engagements

Professional services are governed by separate service agreements or statements of work. These Terms apply to website use and general interactions with CLIMB IT Solutions. In the event of a conflict between these Terms and a signed service agreement, the service agreement shall prevail.

5. AI-Assisted Services (Odin)

CLIMB IT Solutions offers AI-assisted reporting and analysis through its Odin platform. By using Odin, you agree to the following additional terms.

Informational Use Only

Odin outputs — including reports, data summaries, and recommendations — are informational only and do not constitute business, legal, financial, or professional advice. Clients are solely responsible for verifying all data directly in Odoo or other source systems before relying on it for any business decision.

No Guarantee of Accuracy

AI-generated content may contain errors, omissions, or inaccuracies despite multiple validation layers. CLIMB IT Solutions makes no warranty, express or implied, regarding the accuracy, completeness, or fitness for purpose of any Odin output.

Client Responsibility

  • ✓The client is solely responsible for all business decisions made using or influenced by Odin outputs.
  • ✓The client is responsible for providing valid API credentials and for the Odoo permissions those credentials grant. CLIMB IT Solutions is not liable for actions taken within Odoo as a result of permissions granted by the client.

Data Flow & Privacy

To deliver Odin functionality, client data is transmitted to AWS Bedrock (Anthropic Claude) for processing. The following data handling practices apply:

  • ✓All transmissions are encrypted in transit and at rest.
  • ✓Query results and audit logs are stored on CLIMB IT infrastructure in encrypted form.
  • ✓Client data is never shared between tenants.
  • ✓Client data is never used to train AI models.
  • ✓CLIMB IT Solutions may retain anonymized usage patterns and query history to improve the Odin product.

Service Availability

Odin is provided on a best-effort basis. No uptime guarantee or service level agreement (SLA) applies unless separately agreed to in a written service agreement. CLIMB IT Solutions reserves the right to modify, suspend, or discontinue Odin at any time with reasonable prior notice.

Limitation of Liability for AI Outputs

The limitations of liability set forth in Section 7 apply explicitly and without limitation to any loss, damage, or claim arising from AI-generated reports, data summaries, recommendations, or other Odin outputs, regardless of the cause.

6. Disclaimer of Warranties

THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLIMB IT SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

8. Indemnification

You agree to indemnify, defend, and hold harmless CLIMB IT Solutions, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the website or violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action shall be brought exclusively in the federal or state courts located in Miami-Dade County, Florida.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use constitutes acceptance of the new Terms.
